If your inquiry aims at concluding a contract, then the additional legal basis for processing is Art. 6 para. 1 lit. b GDPR. Your data will be deleted after your request has been processed. This applies when it is clear from the circumstances that the matter has been finally clarified and if there are no statutory retention obligations.

  1. Use of customer data for direct marketing

5.1 Subscription to our email newsletter

If you subscribe to our email newsletter, we will send you regular information about our offers. The mandatory data for sending the newsletter is your email address. Providing additional data is voluntary and is used to address you personally. For sending the newsletter, we use the so-called double opt-in procedure. This means that we will only send you an email newsletter once you have explicitly confirmed that you consent to receiving the newsletter. We will then send you a confirmation email, asking you to confirm by clicking a corresponding link that you want to receive the newsletter.

By activating the confirmation link, you give us your consent to use your personal data in accordance with Art. 6 para. 1 lit. a GDPR. When you subscribe to the newsletter, we store your IP address recorded by the internet service provider (ISP), as well as the date and time of registration, to be able to trace any misuse of your email address at a later time. The data collected during newsletter registration is used exclusively for advertising purposes in the form of the newsletter. You can unsubscribe from the newsletter at any time via the provided link in the newsletter or by sending an appropriate message to the contact person mentioned at the beginning. After unsubscribing, your email address will be immediately deleted from our newsletter distribution list, unless you have explicitly consented to further use of your data or we reserve the right to further use your data as permitted by law, which we will inform you about in this statement.

5.2 Newsletter sending via Flodesk

The sending of our email newsletters is done through the technical service provider Flodesk, 800 Boylston St. Suite 1410 Boston, MA 02199 (http://www.flodesk.com/), to whom we forward the data you provided during newsletter registration. This transfer is made in accordance with Art. 6 para. 1 lit. f GDPR and serves our legitimate interest in using an effective, secure, and user-friendly newsletter system. Please note that your data is typically transferred to and stored on a server operated by Flodesk.

Flodesk uses this information to send the newsletters and conduct statistical analysis on them on our behalf. To analyze, the sent emails include web beacons or tracking pixels, which are 1-pixel image files stored on our website. This allows us to determine whether a newsletter message has been opened and which links, if any, have been clicked. With the help of web beacons, Flodesk automatically generates general, non-personal statistics about the response behavior to newsletter campaigns. Based on our legitimate interest in statistically analyzing the newsletter campaigns to optimize marketing communication and better target the recipients, web beacons also collect data of the respective newsletter recipient (email address, time of retrieval, IP address, browser type, and operating system) and process them. This data allows individual conclusions to be drawn about the newsletter recipient and is processed by Flodesk for the automated creation of statistics that show whether a particular recipient has opened a newsletter message.

If you do not want the data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter.

Flodesk can also use this data in accordance with Art. 6 para. 1 lit. f GDPR for its own legitimate interest in the tailored design and optimization of the service as well as for market research purposes, for example, to determine the countries from which the recipients come. However, Flodesk does not use the data of our newsletter recipients to contact them or share it with third parties.

To protect your data in the USA, we have concluded a data processing agreement (“Data-Processing Agreement”) with Flodesk based on the standard contractual clauses of the European Commission to allow the transfer of your personal data to Flodesk. Google (Universal) Analytics
This website uses Google (Universal) Analytics, a web analytics service of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”). The plugin protects the website and its IT infrastructure from unauthorized third-party access, cyberattacks, and viruses/malware. Wordfence collects the IP addresses of users and may also gather additional data about your behavior on our website (in particular, URLs visited and header information) to detect and defend against unauthorized access and threats. The collected IP address is compared with a list of known attackers. If the collected IP address is identified as a security risk, Wordfence may automatically block access to the site. The collected data is transferred to a Defiant Inc. server in the USA and stored there.
These data processing activities are carried out in accordance with Art. 6(1)(f) GDPR, based on our legitimate interest in protecting the website from harmful cyberattacks and ensuring the integrity and security of its structure and data.
Defiant Inc. relies on the standard contractual clauses pursuant to Art. 46(2)(c) GDPR as the legal basis for the transfer of data to the USA.
If website visitors have login rights, Wordfence also places cookies (small text files) on the device used. These cookies enable location and device information to be read to determine whether the login attempt is legitimate. They also evaluate access rights and release permissions according to the user’s status. Finally, the cookies register irregular access attempts from new devices or locations and notify other administrators.
